hello I'm Kathleen the other cord I'm Lief Simon聽 welcome to the next edition of our podcast from聽聽
[5]
Paris we continue in sequester here in our little聽 apartment in Paris we've stopped counting the聽聽
[12]
weeks I couldn't tell you how long we've been here聽 and we still don't know when we'll be leaving but聽聽
[17]
maybe macron is suggesting the middle of May聽 which means still a few weeks ahead of us so聽聽
[23]
we continue to look for ways to fill our time I聽 did a very thorough deep spring cleaning of our聽聽
[30]
apartment a most recent weekend and leaf on a line聽 and with bought for me which I really appreciate聽聽
[37]
him some IV and lavender plants that I was able聽 to plant in our window boxes right so thankfully聽聽
[44]
the mail service is still working in France we聽 can order online although my friend was shutting聽聽
[50]
down that was on for non-essential stuff because聽 of some issues inside their concern yeah inside聽聽
[57]
their Depot's so I think I got my lavender and聽 IB justice what they're exempt from Amazon so聽聽
[62]
ok it came from a plant place in France Oh then so聽 there's a few for me I use Google Translate lookup聽聽
[69]
what I want to find in English and put it in the聽 translator then put that into Google in French聽聽
[74]
and I can find lots of websites that deliver okay聽 alright let's dive into our questions please keep聽聽
[79]
them coming we really appreciate all the feedback聽 that we're getting all right from Mike B in the聽聽
[84]
United States Kathleen and Leif we are planning a聽 move out of the United States possibly to believe聽聽
[90]
our retirement will come from pension plans聽 in the US if we receive our checks in Belize聽聽
[96]
we understand that we still will have to pay US聽 federal taxes however there is no domicile state聽聽
[102]
that can collect taxes so doesn't that amount to a聽 tax break or am I missing something right it does聽聽
[109]
if you're coming from a state the taxes pensions聽 so if there are several states in the US you as聽聽
[114]
you may already know that don't text personal聽 income at all Texas and Florida and a few others聽聽
[120]
I forget there's about five and then there are聽 other states that don't actually tax pensions on聽聽
[127]
retirees and I think that list jumps to about聽 twelve so right if you're coming from a state聽聽
[133]
that does tax attention once you move overseas聽 and break that chain of presidency or domicile聽聽
[139]
is more someone used then you wouldn't be paying聽 that state tax anymore you still pay federal tax聽聽
[145]
and in Belize it's not an issue because they tax聽 on a jurisdictional basis that would made tax on聽聽
[152]
the retirement income there other countries you聽 might move to might tax a foreign pension most聽聽
[157]
don't so it's a question to ask if you are text聽 in the country where you're residing you'd be聽聽
[164]
able to get a tax credit on the US side or there聽 could be a double taxation treaty which basically聽聽
[168]
tells which country it gets to tax which type of聽 income so if you're coming from a high tax state聽聽
[176]
this is a nice bonus right if you're coming from聽 a place like California but California doesn't聽聽
[182]
give up their hold on you very much tax easily聽 so a lot of Californians will make an interim聽聽
[189]
move to a place like Texas or Florida that's a聽 good break that sequence with California cleanly聽聽
[195]
before they leave the US so California could have聽 no claim right okay all right this question comes聽聽
[201]
from Jeff F also in the United States isn't there聽 a social security penalty for retiring overseas聽聽
[207]
many in my wife's family believe so they say that聽 you would get only two-thirds or three-quarters of聽聽
[214]
your check if the Social Security Administration聽 knows that you have retired overseas for example聽聽
[219]
to Mexico where I guess they are thinking of going聽 but I think part of the key is the family members聽聽
[224]
aren't US citizens and presumably their green card聽 holders but know moving overseas doesn't hinder聽聽
[231]
your right or ability to collect Social Security聽 especially if you're a US citizen or u.s. green聽聽
[238]
card holder if you're then forget what the exact聽 term is but if you're not a green card holder but聽聽
[245]
are eligible for Social Security we've been moved聽 overseas then you might depending on where you are聽聽
[252]
and what your citizenship is there might be some聽 restrictions on that but generally speaking US聽聽
[257]
citizens moving overseas there's no restrictions聽 on them collecting Social Security unless you're聽聽
[264]
gonna move to Cuba or Iran or North Korea which I聽 don't think is an issue for most people but this聽聽
[269]
is this is a good topic we get lots of questions聽 all the time about Social Security and so the聽聽
[274]
fundamentals are you don't lose it by retiring聽 overseas you aren't penalized for retiring聽聽
[280]
overseas and you can have it direct deposited聽 to an account in many countries overseas but聽聽
[286]
you can't so that answers the question how do you聽 access it well you can have it delivered to your聽聽
[290]
bank directly in any number of countries right聽 okay Gary C from the United States Kathleen thank聽聽
[298]
you for everything I love reading your dispatches聽 and I'm enjoying the podcasts Thank You Kathleen聽聽
[302]
I know that some income earned overseas can be聽 excluded from my US tax return but what about聽聽
[308]
an internet business where the income is derived聽 from many different countries in other words if we聽聽
[313]
move to Panama to run our business is the income聽 excluded regardless where it comes from even if聽聽
[319]
it comes from the United States all right so what聽 Gary is asking about is the foreign earned income聽聽
[324]
exclusion and so there's two ways to qualify for聽 that being a bona fide resident of another country聽聽
[330]
or the day's test which means being in another聽 jurisdiction for 330 days or more the reverse of聽聽
[338]
that is being outside of the US for at least 330聽 days although you have to be in another another聽聽
[344]
jurisdiction interest international waters and if聽 you qualify then what matters is where the income聽聽
[351]
was earned so even if you're a bona fide resident聽 of another country in your consultant and you go聽聽
[355]
work two weeks in the US for one of your clients聽 those two weeks that you're in the US or won't聽聽
[360]
fall under the foreign earned income exclusion聽 in other words it'll be taxable but if the if you聽聽
[366]
have an internet business and you have people聽 buying from the US but you're in Panama doing聽聽
[371]
the work you know keeping the website up doing聽 whatever work is necessary for your business聽聽
[378]
you're doing the work in a in another country聽 outside the US and so it does qualify for the聽聽
[382]
foreign earned income exclusion okay so this聽 can get complicated one of the fundamentals to聽聽
[388]
understand with this in general because it's聽 another topic we get so many questions about聽聽
[392]
is that it has to do with earned income firstly聽 right passive income no matter where you are what聽聽
[399]
description or any there it's not relevant it's聽 not exactly we get the question a lot from people聽聽
[405]
who want to move overseas and be day traders they聽 say day trading is work they're put there that's聽聽
[412]
what they do every day but that's still just聽 investments so you can't qualify as a day trader聽聽
[417]
for the foreign earned income exclusion okay聽 Kathleen if I move overseas could I ever return聽聽
[423]
to the United States oh I have a great sarcastic聽 answer if you haven't met Leif at a conference聽聽
[428]
yet you haven't had the privilege and the pleasure聽 of enjoying his no holds bar response is which he聽聽
[436]
gives in person he's being a little I'll hold my聽 tongue and not get political today but of course聽聽
[442]
if you're us and you have the right to return to聽 the US anytime you want and we talked about this聽聽
[448]
in the context of getting multiple citizenships聽 and residency's for being allowed to be in a聽聽
[456]
country Kathleen and I have Irish resident sorry聽 Irish citizenship which allows us to be in the EU聽聽
[462]
and live in Ireland before we could get residency聽 and another EU country if we wanted to as well as聽聽
[469]
our US citizenship and so during this coronavirus聽 lockdown question was okay well where do we want聽聽
[474]
to be locked down we have Panama residency we were聽 trying to get back to Panama before it closed down聽聽
[480]
but the country closed down so in the current聽 situation it's more difficult to get back to聽聽
[484]
where you want to be or where you're allowed to be聽 but generally speaking if you're a US citizen have聽聽
[489]
a US passport you can return to the US any time聽 okay we will call it a wrap there for another聽聽
[495]
episode of our podcast from Paris please continue聽 to stay safe stay well stay comfortable and keep聽聽
[503]
your imagination going during this period of聽 pause we'll be in touch again soon thank you
