think would be really useful for you to

have so again in the cases we see a lot

of time and money is spent as a result

of people not being able to gather
[41]
information and then leaving it to the
[43]
lawyers to try and collect documents and
[46]
information that they should really have
[48]
themselves they'll often curse
[50]
themselves and say why didn't I click
[51]
that before I left the home or why don't
[53]
the other party take that so by taking
[56]
this step not here you're saving
[57]
yourself time and money but you're
[59]
making sure you're not disadvantaged and
[60]
that you have all the information that
[62]
you need your lawyer needs and in the
[66]
unfortunate situation where the matter
[68]
does go to court that the courts got
[70]
everything they need to be able to make
[72]
an assessment as to what you're both
[74]
entitled to so there's a range of
[77]
documents some involve the children some
[79]
don't so if we start with the documents
[81]
which are pretty useful to have
[83]
regardless of whether or not there are
[84]
children that would be your marriage
[87]
certificate
[88]
titles to the property now most people
[90]
do have their titles to the property
[92]
held in a deed box at the bank but in
[94]
some instances people haven't got around
[95]
to placing in a secure place so you can
[98]
either bring that title to your lawyer
[99]
or take it into a safety deposit box it
[102]
really shouldn't be at home anyway it's
[104]
useful to get bank statements mortgage
[106]
statements credit card statements tax
[110]
returns superannuation statements now as
[113]
to how far back you go useful probably
[115]
to go back three to five years and to
[118]
get current statements if you can also
[120]
passports particularly if there are
[122]
children so many instances people are
[124]
fearful that their partner may take off
[126]
to another country with the children and
[128]
that may or may not be a Hague
[130]
Convention country and it's just one
[132]
worry you may want to eliminate so if
[134]
you take the passports and again put
[135]
them in a deed box with the title
[137]
or take them to your solicitors they'll
[139]
be there for safekeeping payslips are
[141]
also useful to show what the current
[143]
income is of your partner and then also
[146]
any other documents that you think
[149]
relate to your relationship and the
[151]
finances of you and your partners so in
[152]
some instances there are trust deeds
[154]
company documents accountant statements
[158]
calculations that the two of you have
[160]
made when you've tried to work out what
[163]
your finances were going to be like in
[164]
the future or how you're going to retire
[165]
those workings and documents are useful
[168]
so that we know what the assets were
[170]
what was going to be expected to come in
[172]
from either the running of a business or
[174]
from an investment you can get those
[177]
documents from your accountant but again
[178]
that can be expensive and a duplication
[180]
and so if you've got those documents at
[182]
home worthwhile getting now don't panic
[185]
if you can't find that and don't let
[187]
that stop your separation if that's
[189]
what's holding you back
[190]
we can always obtain that information by
[192]
subpoenaing documents through the core
[194]
process by contacting the superannuation
[197]
fund of your partner there's now
[199]
legislation in place that allows us to
[200]
do that whereas previously we have to
[202]
rely on trying to find it you can
[204]
actually get that information quite
[206]
easily and readily but anything that you
[208]
can do to help yourself
[209]
as I said saves time and saves money and
[212]
what you don't want is to be paying
[214]
solicitors an hourly rate to do
[216]
something that you can do yourself so
[219]
once you've got all that information put
[221]
it into a folder and then take it to a
[223]
safe place
[224]
don't leave it at home don't leave it in
[226]
the car take it to a friend or to your
[228]
work place where your partner can't
[230]
access it alternatively you may want to
[232]
photocopy it and then return it back to
[234]
where you found it either way as long as
[236]
you've got a set that's in a safe place
[238]
you'll be well-equipped and this is the
[240]
very thing that can often delay
[242]
processes in settlement can often cost
[246]
lots of money because letters are being
[247]
passed between solicitors while they're
[249]
gathering this information rather than
[251]
calculating the range itself which as I
[253]
said is a topic in itself and will be
[255]
dealt with later in one of the other
[256]
videos so now you've got all the
[260]
information you need into terms of
[262]
action that you can take straight away
[263]
without consulting a solicitor and you
[266]
can either decide to wait till you've
[269]
decided whether or not you want to
[270]
separate

or you can go and make an appointment
[272]
with a lawyer and any one of our team
[274]
can see you for a first appointment free
[276]
and if you take that information with
[278]
you you'll find that you breeze through
[279]
the appointment and the by the
[281]
conclusion of the appointment or by the
[283]
end of this series of videos you'll have
[286]
an idea of the range of settlement and
[288]
the expectation you'll have in relation
[291]
to your children prior to any other
[293]
court action so that's it for module one

two things that you've done firstly you

should have taken a series of actions

which will give you a piece of binding

security in knowing that you've attended

to certain housekeeping matters and

secondly you should have a folder of

documents which will put you in good

stead regardless of where you are in
[316]
legal process and regardless of where
[318]
you're going to end up now if you're
