today's video I wanted to talk a little

bit about bankruptcy and Dave Ramsey and
[22]
you know someone who deals with debt and
[25]
people's debt problems all day long I
[27]
often get asked what I think about Dave
[29]
Ramsey and people actually think that
[33]
there's some kind of tension between the
[35]
the Dave Ramsey approach to dealing with
[37]
debt and the way the bankruptcy
[38]
attorneys deal with that and a lot of
[41]
people are surprised to hear I'm a big
[42]
proponent of Dave Ramsey I actually have
[45]
a lot of his books all over my office
[49]
because I think that it is a great way
[52]
to deal with it and I can tell you that
[55]
Dave Ramsey and his company they
[57]
actually used to provide some credit
[61]
counseling classes that went along with
[62]
the bankruptcy process when a person
[65]
files for bankruptcy they have to take
[66]
to credit counseling classes one before
[68]
they file for bankruptcy and one after
[71]
and Dave's company provided the course
[74]
that people completed after they filed
[77]
for bankruptcy that gave some tips and
[79]
strategies on how to stay out of debt
[81]
going forward and kind of a sighted she
[84]
was kind of interesting they wouldn't
[85]
provide the classes prior to bankruptcy
[88]
because they felt that was inconsistent
[90]
with the message that Dave preaches on
[92]
the radio which is to try to avoid
[94]
bankruptcy if you can if it's all
[96]
possible and as part of for being a
[99]
provider of his courses actually once a
[101]
year he had a conference of sorts out in
[105]
Tennessee in Nashville at his
[107]
headquarters where all these bankruptcy
[109]
lawyers they used his courses would come
[111]
in and he would talk to them and give
[113]
training and different ideas on business
[115]
management and it was really cool
[118]
because we got to go back to and see how
[119]
the whole Dave Ramsey headquarters works
[121]
we got to see him do a radio show live
[123]
and he even had a dinner that he held at
[126]
his house Nashville which was really
[129]
cool because I got to go there we're
[131]
having dinner with him and
[132]
remember standing out on his back porch
[133]
just talking today Ramsey about his
[136]
radio show and you know of course was
[139]
being a bunch of bankruptcy attorneys
[140]
there the conversation came up the other
[143]
person you know is he anti bankruptcy
[145]
and I don't believe that he is anti
[149]
bankruptcy and I obviously I don't speak
[151]
for him but his thought was look
[153]
sometimes it is necessary for people to
[157]
file for bankruptcy here's a picture
[160]
that's a me and Dave out of the
[162]
headquarters but you know what his
[164]
thoughts were is look bankruptcy for too
[167]
many people is the first option it's the
[169]
first thing they think about when they
[170]
want to get out of debt when there's
[172]
other ways you can get out of debt
[174]
particularly through like the Financial
[176]
Peace University and some of the
[177]
different you know the debt snowball
[178]
things like that that he is a proponent
[180]
of and I'm in an agreement with that the
[182]
bankruptcy is not a good fit for
[185]
everyone it's not a good fit for a lot
[187]
of people there's a lot of other reasons
[189]
even besides the fact that there's
[190]
programs like Dave Ramsey program the
[193]
Financial Peace University which I've
[195]
taken that class by the way like I said
[197]
it's something where I try to instill a
[199]
lot of those things not only to my own
[200]
life but into helping clients who are
[202]
dealing with debt problems but there are
[205]
certain times when bankruptcy is
[208]
necessary and I think even Dave Ramsey's
[211]
agree with this because a lot of people
[213]
know Dave filed bankruptcy himself when
[215]
he was a young man and had lost his
[217]
business and he related that story to us
[220]
when we were back there in Nashville and
[222]
the story was that you know he had lost
[224]
his company he owed millions of dollars
[227]
and he had done his very best of pay
[229]
everybody back and he actually made
[230]
incredible progress paying back millions
[233]
of dollars but that everything was
[236]
really leveraged and you know Aldi
[237]
secured debts and one of the creditors
[240]
was threatening to repossess some of the
[242]
furniture that they had in their home
[243]
and so he ended up having to file for
[246]
bankruptcy to stop that because once
[248]
somebody filed for bankruptcy it stops
[251]
collections it stops repossession of
[253]
cars or foreclosure of homes or taking
[255]
of furniture or you know any of those
[257]
things so that's why he did it because
[259]
he had to stop it because the creditors
[261]
had sued him they got judgments and now
[264]
they were trying to
[265]
levy on assets and repossess things and
[268]
that is really the situation where I see
[270]
where bankruptcy makes sense for most
[272]
people one of the areas is when there is
[274]
an emergency when there's a foreclosure
[277]
sale that's pending when your car is
[279]
going to get repossessed if your wages
[281]
are being garnished and you can even buy
[283]
groceries because it's making things so
[285]
tight bankruptcy is very powerful then
[288]
because it stops the collections it
[290]
stops the garnishment stops the
[292]
foreclosure sale stops the repossession
[294]
and gives you some breathing time to
[296]
kind of decide what it is that you want
[298]
to do you know you can complete the
[300]
bankruptcy and eliminate the debts maybe
[302]
a chapter 13 bankruptcy where you're
[304]
restructuring things so that you can pay
[306]
less but still pay something towards
[308]
your creditors that's probably the
[309]
number one area where I see where
[311]
bankruptcy is a necessity is if things
[315]
have gotten that far
[317]
second way is if there really is just a
[319]
realistic option for repayment and I see
[322]
this a lot with medical bills people who
[324]
come in have just hundreds of thousands
[326]
of dollars of medical bills I see it
[328]
when there was a business that's
[329]
collapsed where a business had a lot of
[331]
lines of credit and they were personally
[333]
guaranteed and there's just simply no
[335]
way based upon the income level that
[337]
those people have that they are ever
[339]
going to be able to get out of that
[340]
situation in those types of situations
[343]
bankruptcy can make quite a bit of sense
[345]
so definitely a big fan of Dave Ramsey
[348]
Dave Ramsey show listen to it my wife's
[351]
a big fan we've been to Financial Peace
[353]
University but I do think and I think
[356]
Dave would agree that there are
[358]
situations where definitely it is
[360]
necessary it just doesn't need to
[361]
bankruptcy doesn't need to be the first
[363]
step that people take that impair their
[366]
options and I talked about those options
[369]
in my office so I knew with people for
[371]
consultations we discussed bankruptcy
[373]
options but we also go over the non
[374]
bankruptcy options that are out there
[376]
one of which being you know Total Money
