that we're experiencing in this country

about 1.7 trillion dollars of

outstanding student loan debt it is

insane

but he has reneged on that promise as

modest as that promise was and now it

turns out that

the

biden administration is getting involved

in a case where a judge actually decided

to discharge hundreds of thousands of
[34]
dollars of student loan debt for someone
[37]
who is
[39]
not healthy enough to pay it back
[41]
the fact that the education department
[43]
under the biden administration has filed
[45]
an appeal in that case
[47]
tells you quite a bit
[49]
so first before i get to what the biden
[50]
administration is doing i think it's
[52]
important to give you context about the
[53]
case

so it involves a student a former
[57]
student
[58]
who has graduated graduated back in 2010
[61]
who's suffering from some very serious
[63]
health issues and as a result is not
[65]
gainfully employed and can't pay back
[68]
loans now on january 14th a federal
[70]
judge in biden's home state of delaware
[73]
moved to eliminate nearly 100 000 in
[77]
student loan debt held by this 35 year
[79]
old epileptic man

in response the justice department filed
[83]
a notice of appeal in the case on behalf
[86]
of education secretary miguel cardona
[90]
why would you do that we're talking
[91]
about someone who is
[93]
not healthy enough to earn a living to
[96]
pay back those loans why would you
[98]
appeal the judge's decision

well uh let's give you more details on
[103]
just how
[104]
difficult it would be for this student
[106]
to be able to pay back his loans a
[109]
bankruptcy judge found that ryan wolfson
[112]
who held nearly 100 000 in student loan
[115]
debt faced undue hardship
[118]
due to the debt and eliminated all of it
[121]
according to the lawsuit wolfson
[123]
graduated from penn state back in 2010
[125]
and struggled to find full-time
[126]
employment in 2019 while wolfson was
[130]
working full-time driving for uber lyft
[132]
and grubhub he suffered a seizure while
[136]
driving and totaled his vehicle

i mean it is an incredibly depressing

story i mean my heart goes out to this
[143]
guy

he's he's doing what he can he's trying
[146]
so so hard but because of his health
[148]
issues because of the fact that he has
[151]
these seizures he's unable to be
[153]
gainfully employed and to make matters
[156]
worse he's got this 100 000 debt on his
[161]
shoulders

holding him down and he's filing for
[164]
bankruptcy and because of biden's
[167]
bankruptcy bill years ago students are
[170]
unable to discharge their student loan
[172]
debt even if they file for bankruptcy

the only way you can do it is if you can
[177]
prove
[178]
that there is an undue burden that
[180]
prevents you from being able to pay it

back and uh even though it is incredibly
[185]
rare for a judge to side with the
[187]
individual with the loans

in this particular case the judge is
[191]

your situation is terrible

you're not going to be able to pay back
[196]
these loans i'm going to help you

discharge them through your bankruptcy

the evidence shows wrote the judge that
[203]
despite considerable effort wolfson has
[206]
been chronically unor underemployed
[209]
since graduating from college that his
[212]
sporadic full-time employment has
[213]
consisted of low-paying gig work or jobs
[216]
with little prospect of advancement and
[219]
that he has avoided living in abject
[221]
poverty only through significant
[224]
financial support from his father
[226]
the record further shows that wolfson's
[229]
career prospects are unlikely to
[231]
materially improve over time and thus
[234]
his inability to pay his student loan
[236]
debt will persist
[238]
and by the way just how hard is it to
[241]
prove that you have an undue burden that
[243]
your or undue hardship that prevents you
[246]
from being able to pay back your loans
[247]
the standard is incredibly high and the
[250]
reason why the standard is incredibly
[251]
high is because biden fought for that
[253]
standard to be high as he was
[255]
championing his bankruptcy bill

federal circuit courts have interpreted
[259]
this language in different cases to
[261]
demand that debtors show a certainty of
[264]
hopelessness
[266]
or intolerable difficulties or a total
[269]
incapacity to repay

now if i were

part of biden's administration

i would fight pretty aggressively to not

appeal the judge's decision here because

it's just needlessly cruel

it's so gratuitous it's so unnecessary

it's so rare for a judge to side with

the student debtor

in cases like this

and this judge i believe made the right

choice

but uh the biden administration ain't

having it they decided to appeal

i i don't know what the buying

administration is doing because

it turns out that the reason why this

appeal happened in the first place is

because there is a trump administration

left over that the blind administration

has refused to replace

um so in its first year this is graphic

the bind administration also routinely

fought such attempts by people who hold

student debt to have it relieved in

as the attorney general is supposed to

then you have this guy campaigning on

forgiving a measly ten thousand dollars

in student loan debt he didn't even do

that he just reneged on that

he doesn't even have you know maybe he

doesn't have the time what can he do he

doesn't have the time to uh ask a trump

appointee to resign

so we ensure that the education

department doesn't appeal

a judge's decision involving a student

who has a hundred thousand dollars in

student loan debt who has cerebral palsy

and does not have the ability to pay

that loan back

democrats are

looking for any scapegoat anyone to

blame for their

lack of popularity for biden's sagging

approval ratings

but they have no one to blame with

themselves what is biden doing
