So, first of all let's see what is Maternity benefit?

So, this maternity benefit is given to all those insured women
[48]
who take a leave from their work at the time of pregnancy.

So, under this you will get 100% of your wages
[56]
till the duration of maternity benefit from the ESIC department.

So, now let's see the insured women

that are eligible to take this benefit

So, first point to keep in mind is

that you have to do minimum 9 months of service
[74]
during which you must have paid the contribution of ESIC.

Second point to keep in mind is

that in the last two consecutive years,
[84]
there should be a cumulative 70 days ESIC contribution.

It means from April to September or October to March
[91]
these two terms combined should have a 70-day ESIC contribution.

only then you would be eligible for maternity benefits.

Third question that arises is

how much maternity benefit that you can get?

So, there are some cases that will discuss one by one.

So, for knowing this you should know the meaning of one word
[120]
which is confinement. Confinement means
[123]
normal delivery resulting in the birth of a living child
[128]
doesn't matter when did it happen.
[129]
or after 26 weeks
[131]
you have a normal delivery resulting in the birth of a living child
[135]
or a miscarriage.but after 26 weeks.

This is called as confinement.

So, let's see how much maternity benefit would be available.

If you have had a normal delivery
[146]
or a miscarriage after 26 weeks.
[149]
In that case you will get the materinity benefit for full 26 weeks
[153]
and this has been implemented from last year's amendment.

Out of these 26 weeks you can even
[159]
take leave 8 weeks before the delivery
[163]
and then also you will continue to get this benefit
[165]
but keep in miind the total benefit cannot be more than 26 weeks.

Second case, if you adopted a child

The first condition in this case is
[173]
that the child should be legally adopted.
[178]
Secondly, the adopted baby should not be older than 3 months.

If these two conditions are fulfilled
[185]
then you will get a 12 month maternity benefit.

Third case is miscarriage.
[190]
Miscarriage means if your pregnancy has been terminated
[193]
before 26 weeks, then in that case
[195]
you will get a 6 week maternty benefit
[199]
Fourth case is sickness arising due to pregnancy.
[203]
Many a times, during pregancy or after pregnancy
[206]
you fall sick. In this case you will get a 4 week maternity benefit.

Fifth case is 'Death due to pregnancy.'

In this case, the maternity benefit of the insured woman
[220]
would be given to her nominee.

So, the benfit would be given to the nominee that you have selected.

One more thing to remember in this is
[229]
that it has benefit named 'Confinement Expenses'
[234]
which is given to you when
[235]
your delivery has happened in such a place
[238]
where proper medical facilities are not available under ESIC
[242]
to execute the delivery.

In that case you are given a lumpsum benefit of Rs 5000.

This benefit can be availed by the insured woman or
[252]
the husband whose wife's delivey
[255]
has happened in a place where
[256]
proper ESIC facilitated delivery options were not available
[262]
But friends, keep in mind this benefit can only be availed
[265]
only till two confinements
[267]
or it is available only for two deliveries
[269]
and won't be given for the third delivery.

This 26 weeks benefit
[272]
would be only available upto 2 surviving children.

If you have a third delivery,

then in that case you will get only 12 weeks benefit instead of 26.

here you should focus on the 'surviving' word.

If you had total 3 deliveries out of which one was a miscarriage
[290]
then also you will get 26 weeks benefit because
[293]
your surviving children are only 2.

Next topic is, if you want to claim the maternity benefit

then how can you claim it?

For this, there is 'Form 19'
[303]
that you have to fill,
[304]
go to your nearest ESIC dispensary
[307]
you will have a checkup there.
[309]
From there, you have to get the form submitted from there.

After this only you can get this maternity benefit.

The second case that I told, i.e. death case

where full benefit is given to the nominee.

For this the nominee has to fill 'Form 20.'

on your Employees' ESIC portal.

If you search 'ESIC Employee Login' on Google

then you will get this portal.

The first link would be 'esic.in/Employee Portallogin.'

After clicking on this link,

you have to enter your 'IP number' on 'User Name'

and enter 'Captcha' in Captcha field and click on login

After logging in the window that is important for you is

that is 'Entitlement to Benefit.'

You can see your common information above

and check your IP number here

and confirm it.

with benefits that you are entitled for

depending on your contribution history

for claiming maternity benefit, as we had told earlier

your minimum service in the last period should be of 70 days.

of both the periods is greater than 70 days

so it is showing 'yes' here for maternity benefit.
