very often parents and other individuals who聽聽

and want to apply for social security benefits聽聽

for that individual but realize that that person聽
cannot handle their own financial decision making聽聽

want to be able to have authority to use聽
social security benefits for that person's聽聽

care and other needs and the way to do that聽
is to apply to be that person's what's called聽聽

representative payee, that is the designation聽
by the social security administration聽聽

that acknowledges that a disabled individual聽
who is receiving social security disability聽聽

benefits or supplemental security income is聽
unable to handle financial decision making聽聽

themselves and needs an advocate or a proxy聽
recognized by social security to do that聽聽

so a representative payee is either an individual聽
or it can be an organization. in missouri sometimes聽聽

a company called empower me is appointed聽
as a representative payee if someone is聽聽

residing in a long-term care facility聽
that facility to which social security聽聽

benefits are paid for lodging or residential聽
treatment is made the representative payee聽聽

and that is an appointment through social聽
security for the management of the benefits聽聽

of a person who's disabled who cannot聽
handle their own financial decision making聽聽

so the main responsibilities of a individual聽
or entity that is named as a representative payee

is to use the benefits that that person receives聽
for current and future foreseeable needs for that聽聽

individual. now if someone is the representative聽
payee for an individual who is receiving聽聽

supplemental security income benefits there聽
are more restrictions on the use of those funds聽聽

so ssi benefits or supplemental security benefits聽
are used primarily for shelter and food for that聽聽

individual so there are strict requirements聽
that are beyond the scope of this talk today聽聽

for which those ssi benefits must be used. so聽a person or an entity that is a representative聽聽

payee for those benefits really has to know how聽
those benefits can be used and any benefits that聽聽

are not used in a particular month would be saved聽
for future use for the benefit of that individual聽聽

a representative payee must also keep excellent聽
records of how benefits are used, keep track of聽聽

the monthly benefits, any notices that are received聽
from social security administration, and provide聽聽

reports on an annual basis that are sent by聽
social security to the representative payee聽聽

to account for how those benefits are used on a聽
monthly basis. how to become a representative payee聽聽

usually a parent if we're talking about an聽
individual not a special needs trustee would聽聽

become the representative payee for a disabled聽
child social security payment whether that be聽聽

again ssi or ssd social security disability.聽
if the parent is the special needs trustee聽聽

certainly the special needs trustee聽
could be the representative payee聽聽

but it's usually someone who is living with and very intimately familiar with the ongoing聽聽

daily and monthly needs of the disabled聽
individual and it's very easy to apply for聽聽

representative payee status by going to the聽
social security website which is www.ssa.gov

there is guidance on that website if you just type聽in "how to become a representative payee" they guide聽聽

you through that process. the application itself is聽
an ssa-11 which is the request to be selected as聽聽

representative payee and the documentation that's聽
required to be submitted with that form to be聽聽

representative payee and generally social security had聽
been requiring pre-pandemic that the application聽聽

also be accompanied by a face-to-face聽
interview but some social security offices are not聽聽

having face-to-face interviews so there may聽
be a telephonic interview or you would contact聽聽

your local social security office to see聽
if they are now scheduling those interviews聽聽

so once an entity or an individual聽
is appointed as representative payee聽聽

the responsibility of the individual is to set up聽
a representative payee checking account into which聽聽

the funds will be directly deposited by social聽
security and the titling of that account is聽聽

checking account because the assumption is going聽聽

to be that those funds are going to be used on聽
a regular basis, monthly basis, for the individual聽聽

if there are monies that are not going to be used聽
on a monthly basis now most checking accounts do聽聽

not carry interest but if there are additional聽
funds or a back award since an individual聽聽

who receives social security can keep up to聽
two thousand dollars in their name to have an聽聽

interest-bearing account for those funds is聽
something that social security really prefers聽聽

so the representative payee is not required to聽
use any of their own funds for the needs of the聽聽

disabled individual but again must exclusively聽
use the funds of the disabled individual for聽聽

that person's benefit. the only exception is if聽
the disabled individual is over the age of 18聽聽

and living with a parent or someone else and聽
their social security would be paid as rent or for聽聽

food and rent to the individual with聽
whom they're living pursuant to a rental聽聽

agreement so that is often an agreement that聽
is drafted by attorneys and submitted by the聽聽

parent or the representative payee when聽
actually the social security is paid for聽聽
[418]
food and shelter and that is a legitimate payment聽
for value. the representative payee can also be聽聽
[424]
reimbursed for out-of-pocket expenses that are聽
incurred on behalf of the disabled individual聽聽
[429]
but again they must keep excellent records to聽
substantiate any reimbursement to social security
