when it comes to a waiver of segregation

for your workers comp few things we need

to kind of break down real quick and
[39]
then we'll understand what the waiver is
[41]
first and foremost what is subrogation
[42]
in general it is when uh there is uh
[46]
incident reported on your insurance
[48]
which ultimately wasn't your fault that
[50]
is a broad high-level way of explaining
[52]
it but essentially
[54]
say an employee comes in injured but
[56]
that injury occurred on the property uh
[60]
doing work for
[61]
say
[62]
a third party or a client and they were
[65]
actually responsible for the injury so
[68]
what that means is you have a claim on
[71]
your workers comp policy that was
[73]
someone else's fault so in this case

what would happen is that claim would be
[77]
registered to your insurance and then
[79]
your insurance company your workers comp
[81]
company would go and they would recoup
[84]
the money for that claim from the client
[87]
or third party who who was actually
[90]
responsible for the injury to your

employee so this isn't a fairly common
[97]
thing uh only because oftentimes uh in

the course of work you know it's the
[102]
person's job and it is ultimately your
[104]
worst comp policy response but this does
[106]
happen and oftentimes clients and third
[107]
parties will ask for a waiver of

subrogation

so what a waiver of subrogation does is

say okay
[114]
uh
[115]
your employee got hurt because of
[118]
something we did
[119]
um but in this case because you've
[122]
offered me a waiver of subrogation you
[125]
your insurance company cannot come after
[128]
my insurance company
[129]
for the claim expense so what this does
[133]
is it basically puts all the onus if you
[136]
offer a waiver of subrogation it puts
[138]
all the onus on your business your
[141]
insurance policy so instead of
[144]
um
[146]
that your employee being injured putting
[148]
a claim on your insurance and then your
[150]
insurance company getting that money
[151]
back from your client or third party
[153]
which in this case that would not impact
[157]
your
[158]
uh insurance premiums and most likely
[160]
depending on which state you're in not
[162]
impact your workers comp experience mod

okay which are very good things in this
[168]
case you're denied that right you've
[170]
contractually given up the right to
[173]
subrogate against the third party and
[175]
now that uh claim its expense and its
[178]
impact on both your premiums and your
[180]
experience mod you take the full brunt

of so when you are offering a waiver of

subrogation understand that you are
[187]
essentially waiving your right to recoup
[189]
money which should have come from
[192]
someone else now there are many business
[194]
reasons to do this yeah first and
[196]
foremost it may be a requirement of a

contract from a client or third party
[200]
that you ultimately want to do business
[201]
with and in that case you have to make
[203]
the business decision whether you are
[205]
willing to give up
[207]
the your right to subrogation so

essentially subrogation is something
[212]
happens it's the claim is placed on your
[214]
insurance policy but it was someone
[216]
else's fault and your company is able to
[218]
go out through the through the process
[220]
of subrogation and get that money back
[222]
which then reduces the impact to your
[224]
premiums and your claims experience
[226]
that's a good thing however we are often
[229]
asked for waivers of subrogation and in
[231]
those cases if we decide to do that it
[233]
is important that we know we are giving
[234]
away that right to go do that so

just being aware of this concept you may
[239]
be able to negotiate the waiver of
[240]
subrogation out you may not care that is
[243]
a business decision but in terms of your

workers comp waiver subrogation you now
