insurance question the day is how long

does disability insurance claim take to

process and Steven that's a very common
[17]
question that has a lot of variables

that go into that even when I say how
[21]
long take the process is basically how
[24]
long until my claim is gonna be approved

and what are the factors when someone
[29]
calls you with that question that would
[31]
this would answer that question you know

it's going to be in a lot of ways your
[35]
policy you know the language of the
[37]
policy say you're able to extend the
[39]
elimination period if the insurance
[42]
company has all the information if
[43]
they've requested information from you
[45]
and you haven't provided it that cuts
[47]
into the amount of time that they have
[49]
under the law especially under an
[51]
employer provided policy to make a
[52]
decision so there's a lot of factors
[55]
that can really go into it everyone
[57]
thinks the insurance company's dragging
[59]
their feet dragging their feet and they
[60]
do there is there's quite a bit of that
[61]
but there's also a responsibility to the
[64]
insurer to make sure they're providing
[66]
all the information needed so the review
[68]
can be done okay so let's talk let's
[71]
focus this on long-term disability
[75]
applications first of all there's a
[77]
thing called elimination period what is
[79]
that and how long is the common duration
[81]
of an elimination period an elimination
[83]
period is the amount of time that an you
[86]
have to be disabled before long-term
[88]
kicks in in the insurance company will
[90]
not pay you benefits now if your
[92]
employer a short term disability the
[93]
short term disability period in the
[95]
elimination period are the same but it
[97]
does happen that some don't and say you
[99]
have a 90 day which is common usually 90
[102]
days to 180 days or 26 weeks so say it's
[105]
a 90 day and you don't have short term
[107]
you'd have to be disabled without pay
[110]
really coming in for 90 days before your
[112]
long term disability policy would kick
[114]
in and pay you any benefits okay and
[116]
let's go with this scenario that it's a
[118]
90 day elimination period does that mean
[120]
on day 91 the person should be getting
[123]
paid benefits hypothetically yes they
[126]
should be it doesn't mean that they will
[128]
because like I said again it has to do
[130]
with providing of information some
[133]
people wait
[133]
like 30 days or so to make the
[135]
application even so that can slow
[138]
everything down that's why sometimes you
[140]
know having an attorney can be very
[142]
helpful because you know we know what
[144]
the insurance company's gonna want to
[145]
see you gather all that together for
[148]
presentation to make sure that review
[150]
can be done as quickly as possible but
[152]
it's not uncommon if you had a 90 day
[154]
elimination period you could be a month
[156]
maybe two months after the end of that
[158]
before decisions made now if your
[160]
insurance company approves they do have
[162]
to pay you any of the back benefit you
[164]
know back to that 91st day but you know
[167]
you're still there without money so it
[169]
becomes very problematic for a lot of
[170]
people right well the question I gave
[172]
you is kind of a loaded question because
[173]
number one the 90 days is really not 90
[177]
because they always pay in arrears which
[179]
means they're gonna pay 30 days after
[181]
the fact so no one would ever see a
[183]
check until day 120 give or take because
[186]
they pay ahead just like when you work
[188]
you get paid after you do the work so
[191]
the disability carriers pay pay the same
[194]
way the other thing is is that you're
[196]
supposed to be out of work for 90 days
[198]
so how do you go ahead and apply a day
[202]
30 when you don't necessarily know that
[205]
you're gonna be out for another 60 days
[206]
and that's a tricky thing also in terms
[210]
of you know how long does the process
[213]
take so what I like to tell people in
[215]
general that assuming you satisfy the
[217]
elimination period that you should
[218]
expect on a long term disability claim
[221]
at least 60 days until your claim is
[224]
going to be approved from once you
[225]
submit everything that needs to be
[227]
submitted now whether or not if you
[229]
handle your claim on your own you know
[230]
how to submit everything that you think
[232]
needs to be there because I can
[234]
guarantee you and Steve you know this
[236]
that they don't ask you for everything
[237]
in that initial application they
[238]
purposely play this game to say send us
[241]
the form send us a doctor statement and
[243]
that should be okay for now but that's
[245]
never enough the follow-up letter has a
[247]
lot more information being requested so
