how to put a lien on a property so you have聽 to understand what that means what's a lien聽聽

and what does it mean putting it on a property so聽 a lien is a how do you describe a lien is a legal聽聽

obligation that gets filed with a local county聽 that requires the owner of that property聽聽

if they were to sell it or if they want to be lean聽 free to pay it off so the most obvious example of聽聽

a lien is a mortgage which is called the deed of聽 trust in some states it's called the mortgage lead聽聽

of trust in other states in new york we call it聽 a mortgage and that is a lien so the way it works聽聽

when you borrow money what people call getting a聽 mortgage is you borrow money there is a note which聽聽

says uh you owe three hundred thousand dollars at聽 six percent interest payable over 15 or 30 years聽聽

and then there is a mortgage filed that is a lien聽 on the property where if you don't follow the聽聽

terms of the note they can uh they can foreclose聽 on the property due to you not following the terms聽聽

of the loan that's what the lien says there are聽 other types of lien so if you don't pay federal聽聽

taxes you have federal tax lien and they put聽 that on any property that's affiliated with you聽聽

now again these things are put there simply saying聽 hey we know one day the property is going to聽聽

have to be sold right unless theoretically聽 keep the property for a million years um聽聽

most liens just sit there until you want to sell a聽 property a mortgage lane is different because it's聽聽

specific that if you don't follow the terms聽 they can't foreclose there are other places聽聽

uh what the hell is that that noise oh there are聽 other liens where you can foreclose but in general聽聽

a lien is just something that's that's filed聽 against the property so how do you file it so聽聽

why would you even want to follow so in a lot of聽 creative financing that goes on you want to file a聽聽

lien right there's not a lot of creative financing聽 in new york right because subject to basically聽聽

doesn't work in new york spoken about that 100聽 times um and seller financing where you're the聽聽

bank doesn't really work in new york because聽 it takes it could take 12 15 years to foreclose聽聽

but if you want to do some sort of other creative聽 financing where you're going to put a lien on the聽聽

property for example let's say you would buy聽 the property the seller will finance it to you聽聽

no that's not a good example the truth is in聽 general it's used when you're the bank right聽聽

so it happens a lot in the 49 states where you聽 you can be the bank in a state like texas where聽聽

if you have to foreclose it takes 40 days you want聽 to file a lien on the property to protect yourself聽聽

right i'm doing a deal now that's a big mess and聽 then one of my partners is saying we should put a聽聽

lien on it i'm like i don't care i want the deed聽 i want to get ownership of the property and then聽聽

uh people living there i don't want to bother聽 with the foreclosure process i just want to聽聽

uh if they don't do what they say they're going聽 to do i would try to evict them hopefully when the聽聽

moratorium ends but but a lien is the is聽 usually some kind of thing that you owe so聽聽

another type of lead is a mechanics lien right聽 so if you are a licensed a plumber electrician聽聽

contractor and somebody doesn't pay you you聽 could put a mechanic's lien on a property聽聽

now again that doesn't give you the right聽 to foreclose on the property but it says聽聽

that someday you should get paid also very often聽 with a lien when it gets filed interest accruing

crap and um sorry so when interest starts聽 accruing the lien goes up which which is聽聽

an incentive for whoever the lien is聽 placed on to pay off the lien sooner聽聽

instead of waiting for when he sells the property聽 in 10 years so i had a case recently where i put聽聽

a very large deposit down on a very expensive聽 house in the hamptons and then i realized it聽聽

was a title issue and i said i want my deposit聽 back and they refused to give my deposit back and聽聽

then they ended up selling the house to somebody聽 else i still didn't get my deposit back so i sued聽聽

them for the deposit back this was a six-figure聽 deposit and i won i was shocked thought i might聽聽

lose but we won so what the court said is file uh聽 judgment and i we're entitled to to interest we've聽聽

been going through the course for about a year聽 it's pretty quick considering maybe two years聽聽

and um file a judgment and i can collect聽 interest back to the day that we gave the money聽聽

so that those i had two options my first option聽 is contact the other side and say just send me聽聽

the send me the money back all of it today or i'm聽 gonna file a judgment put a lien on on the i can't聽聽

put on the property i gotta own the property聽 or i'm gonna file a judgment against you for聽聽

the property for the for the entire聽 amount plus interest for two years聽聽

so he they chose to just send us the money we聽 got the money back that day so that was good聽聽

that was great but the point is that judgment聽 can become a lien so another example is uh this聽聽

happens to me all the time you i i file uh i sue聽 a tenant for eviction and for non-payment right聽聽

so they don't they owe me money right they owe me聽 a few thousand dollars and the judge finds in my聽聽

favor to evict them and the monetary judgment for聽 three thousand dollars so they give me a judgment聽聽

i have to then go get a transcript of judgment聽 then i have to go to the county clerk and file聽聽

that transcript of judgment so that it becomes聽 an official lien that i can go collect right and聽聽

then how you collect is even more complicated and聽 also that you go get tenants out it's complicated聽聽

you have to get the sheriff to get them out so you聽 get a warrant for possession i have judgment for a聽聽

monetary i'm by the way i've never collected on聽 any of those judgments because most people just聽聽

don't have any assets but you can do that it's聽 probably not even smart anymore the truth is i聽聽

don't want to bother with monetary judgments聽 but i use it as a tool for i use it as a tool聽聽

to get people out so what happens all well聽 i don't want to give away all my secrets but聽聽

the point is you have to follow this link so聽 it has to be followed with the county clerk聽聽

and you have to have some reason to file a lien聽 you have to you can't just i can't just be john聽聽

smith and file a lien against some rich guy in聽 my neighborhood i have to have a reason that the聽聽

court has to order it and then i'll put that line聽 unless you're a mechanic in which case you have a聽聽

very very easy time to put a lien on the property聽 which sometimes sucks because very often what聽聽

happens a lot is you're a homeowner and you pay聽 your general contract the general consciousness聽聽

doesn't pay subcontractor doesn't pay a plumber聽 doesn't pay uh electrician plumber illustration聽聽

just puts a lien on your property and you're like聽 what the hell are you putting in my property for i聽聽

paid i paid for it and he's like well i didn't聽 get paid and that's therefore you have to be聽聽

two sorry sorry so that happens a聽 lot and more than you know which聽聽

is why you got these really good general聽 contracts don't screw over like that so um聽聽

basically that's how you place a lien has to be聽 filed with a local county another very common one聽聽

is small claims court you've got a small claims聽 court which is i think under 3 000 in my county聽聽

you win them you want a summary judgment happens聽 all the time you sue somebody they don't show up聽聽

judge says find your favor then you get a聽 judgment against them which you turn into a lien聽聽

again collecting all means is is a whole nother聽 topic and not easy to do i told you i've had聽聽

no luck with it i've probably gotten 15 or 16聽 monetary judgments never collected any money but聽聽

in general most of my time i just wanted to聽 get the tenants out but it's hard to collect聽聽

but if they do have a income assets you can get聽 a sheriff to collect from them or you can hire聽聽

companies that will find their assets and put and聽 collect from them but the lien itself is just i聽聽

wonder they really should what's that how do you聽 define lean i should know how to basic definition聽聽

of lean right as long as you know something you聽 just can't describe it clearly uh definition

a right to keep possession of property聽 belonging to another person of the聽聽

dead owed by the person is discharged interesting聽聽

i guess that's a good definition right it's聽 always because you owe somebody money right聽聽

federal taxes because you're the government money聽 mortgage because you owe the bet the lender money聽聽

uh mechanics leads because you know the mechanic聽 money that makes sense so it's a right to keep聽聽

possession of property rights not maybe not the聽 entire property but a part of that property to聽聽

belonging to another person obviously until a debt聽 owed by that person is discharged that's beautiful聽聽

that's what it is so that is how what a lien is聽 and how it gets how you put a lien on a property聽聽

is you need to have a usually judgment for that聽 amount and then you file it with the county clerk聽聽

but again it's probably a lot easier or more聽 difficult than other places not so easy here聽聽

the only liens that i've ever placed were the ones聽 where i had a judgment for the league for the for聽聽

the amount and then i put the lien on the property聽 with the county clerk that's really how it works聽聽
