and everyone waits for that moment when

we all learn what the future holds

do you remember where you were around

say 11 p.m eastern on election night in

2008.

11 p.m on the east coast we're back on
[22]
the air and we have news
[24]
an african-american has broken the
[25]
barrier as old as the republic
[28]
barack obama is projected to be the next
[30]
president
[31]
of the united states this is your
[33]
victory
[34]
[Applause]

change has come to america
[49]
that was a big night that was the moment
[52]
of a historic election call and it came
[54]
pretty early
[55]
just moments after the last polls closed
[58]
out west partly because obama had such a
[60]
clear margin
[61]
of seven points but there's nothing
[64]
automatic or legally necessary about
[66]
declaring a winner that
[67]
fast which brings us to tonight's
[68]
special report what you need to know
[71]
about this year's election and why no
[74]
politician not even a president
[76]
can override the vote counting now
[79]
modern technology makes many things
[81]
faster we know that
[82]
we're accustomed to learning who won on
[83]
election night but speed has
[86]
no actual purpose here as a matter of
[89]
governing the winners of federal
[90]
elections have months
[91]
before they take office and this is more
[94]
crucial
[95]
this year because one a pandemic
[97]
election is different
[98]
two president trump may try to exploit
[101]
delays as he's already
[102]
talked about and three totally apart
[105]
from trump
[106]
it's perfectly fine when there's time
[109]
between when people vote
[110]
be it three weeks out or on november
[112]
third and when we get the result
[115]
that was true during the recount in 2000
[118]
then
[118]
president clinton put it simply
[122]
the american people have now spoken but
[125]
it's going to take a little while to
[126]
determine
[127]
exactly what they said
[131]
if this year's race is close it's
[133]
plausible that we will not know
[135]
who the new president will be on the
[137]
night of or the next day or even longer
[141]
and that's okay so let's dig into why
[144]
well the first reason is the most
[145]
obvious this year the coronavirus
[148]
even as we see long lines at the early
[150]
voting locations even this week many
[152]
states
[153]
are expanding how people can vote safely
[155]
from home
[156]
and that's sparking a dramatic rise in
[158]
people voting by mail
[160]
so a close race could require counting
[162]
ballots for weeks and weeks
[165]
now why is that i mean
[168]
just as a basic matter of logic you
[170]
might think getting ballots in early is
[171]
like getting a head start on your
[172]
homework maybe the states could
[174]
count it up early and be even more ready
[176]
well like every other
[177]
legal issue in our federalist
[179]
constitution it depends on the state
[182]
most states allow early ballot
[184]
processing for that head start
[186]
so you have even battleground states
[187]
like nevada georgia and minnesota which
[189]
allow mail and ballots to be processed
[191]
as soon as they're received in some
[192]
states that means today
[194]
but others have laws that ban that kind
[196]
of early counting
[198]
and there are reasons for that it can
[199]
combat potential leaks so officials can
[201]
only start counting
[202]
on the formal election day when we watch
[205]
all those calls come in
[206]
now if you plan to watch as these
[208]
returns come in this year
[209]
this is relevant to your night to your
[211]
november political health the states
[213]
with those laws will take longer to
[215]
count and they include key states that
[217]
mattered in 16 to trump
[218]
like pennsylvania and wisconsin and
[220]
michigan where officials are already
[222]
preparing voters for the wait
[226]
we should be prepared for this to be
[228]
closer to an election week as opposed to
[230]
an election day
[231]
we are not going to have artificial
[233]
deadlines set by
[235]
you know people with political agendas
[236]
we are not going to have the full
[237]
results and accounting of all of our
[240]
ballots on election night
[243]
wow so you heard it right there
[245]
michigan's top vote counter is already
[247]
saying
[248]
they will not have results on election
[249]
night and to think of this as election
[251]
week or more
[252]
governor flat out calling election day
[253]
an artificial deadline
[255]
and separate from no matter who wins
[257]
that's right
[258]
election day is not necessarily a time
[260]
to demand results it's just the time to
[262]
start tallying them
[264]
if the election does hinge on a few
[266]
swing states
[267]
which we know may not have the results
[269]
in election night then you would have a
[270]
longer race
[271]
there are ways election i could wrap up
[273]
just like i showed you with obama
[275]
relatively quickly if biden for example
[278]
won minnesota new hampshire and one
[281]
florida on election night
[282]
then there's a chance he could actually
[284]
have the required electoral votes
[287]
to be declared the winner
[288]
constitutionally and it wouldn't matter
[290]
if there were delays in some of those
[291]
states i just showed you like michigan
[293]
or wisconsin
[294]
now totally apart from this pandemic and
[296]
this president
[297]
there's another way that things can take
[299]
time and that's when a winner emerges
[301]
but it's not
[302]
final so you have the apparent winner
[303]
but the race is close enough to support
[305]
legitimate legal appeals now this is
[307]
important i say legitimate
[309]
because if someone just loses badly and
[311]
files appeals judges
[313]
they tend to toss those cases real quick
[315]
but if it's
[316]
actually close and there are valid
[318]
recounts
[319]
will court battles take time like in
[321]
2000
[323]
this being billed as the polls closed
[326]
before the election
[327]
as the closest election in a generation
[330]
somewhat
[331]
unbelievably here we are now three
[333]
nights after election night and there
[335]
still
[336]
is no president-elect not even close the
[339]
florida supreme court is still
[341]
deliberating tonight
[342]
long after its normal 5 pm deadline both
[344]
sides are studying what happens if this
[346]
race isn't settled by january
[348]
5th the justices working for a second
[350]
night on their historic decision
[352]
while the candidates their lawyers and
[354]
everyone else wonders the same thing
[356]
what's taking so long well the battle
[359]
was
[360]
taking so long because the legal system
[362]
allows it each side
[363]
could have different political
[364]
motivations remember neither party has a
[367]
position on timing or recounts
[370]
in these races both parties will push
[372]
for what helps them win
[374]
in 2000 republicans were arguing well
[376]
bush had already won
[378]
before he legally had democrats were
[380]
arguing look
[381]
nothing's final until there's a full and
[383]
fair count and it's complete
[387]
governor bush won each and every time
[390]
apparently the gore camp is not
[392]
satisfied with that
[393]
and they're going to keep on trying to
[394]
go as long as they can until they get a
[397]
result they like
[398]
the legitimacy of any president that's
[402]
elected
[402]
is going to be impaired unless the
[405]
american people
[406]
understand that there has been a full
[409]
and fair
[410]
count of all the votes george bush is
[412]
president-elect
[413]
now if we continue just to count until
[415]
gore wins
[416]
that will take weeks and weeks and it'll
[418]
be endless litigation
[420]
the american people have now spoken but
[423]
it's going to take a little while to
[425]
determine exactly what they said
[429]
that was right it took a while the
[431]
election was not resolved until over a
[433]
month
[433]
after election day when the supreme
[435]
court ruled to end certain counting in
[437]
florida
[438]
other races though they've taken even
[440]
longer than that
[441]
take 1876 hayes versus tilden
[445]
wasn't decided until the following year
[448]
and non-partisan experts note that
[450]
when it takes extra time that's an
[451]
indicator election officials are working
[453]
through
[454]
safeguards that prevent frauds or errors
[458]
so if you find someone rushing the
[460]
process say
[462]
potentially donald trump they're not
[464]
combating fraud according to the experts
[466]
now some are worried about the
[468]
president's rhetoric this process and
[470]
this timing is not his call
[472]
and he's not the first candidate to try
[474]
to muddy these waters
[475]
even in the most recent elections in
[477]
2018 florida was
[479]
again so close that a recount was
[481]
automatically triggered
[482]
under law republican rick scott falsely
[485]
argued that a careful recount was some
[487]
kind of democratic plot
[491]
i will not sit idly by while unethical
[494]
liberals
[495]
try to steal this election from the
[497]
great people of florida
[500]
so scott made noise but again just like
[503]
trump
[503]
it wasn't his call the counting
[505]
continued and guess what
[506]
he won the point here is not what's good
[509]
for one party or the other but the law
[511]
governs the law provides time to count
[513]
more time to count if there is a recount
[516]
under state law
[517]
and in some places it is true that as
[519]
things come in a later count can tilt a
[521]
certain way for demographic reasons
[523]
slower counting in dense cities
[525]
for example where more democratic voters
[527]
tend to be or it can go the other way if
[529]
male votes are counted first in a state
[531]
and then in person votes
[532]
then lean more republican which is
[535]
entirely possible with trump
[537]
saying people should only vote in person
[540]
now we just showed you florida last
[542]
cycle the republican had the lead
[544]
before and after the recount that's
[545]
typical when a race is super duper close
[548]
and there are errors a recount though
[550]
can still shift
[552]
who leads that's exactly what happened
[554]
in al franken's 2008 race he was barely
[556]
behind in those initial results
[558]
he took the lead only later when all
[560]
votes were carefully tabulated in that
[562]
recount which is for accuracy
[564]
now the republican appealed which is his
[566]
legal right all the way to the supreme
[568]
court
[568]
of that state now that added time the
[570]
whole thing ended up taking
[572]
eight months but the court backed al
[574]
franken in the final tally
[575]
and that republican conceded
[579]
i conducted the legal challenge i wanted
[582]
i have always believed you do the best
[583]
you can
[584]
and you leave the results up to a higher
[586]
authority
[587]
i'm at peace with that
[590]
that is what the rule of law sounds like
[594]
fight hard sure to the end but respect
[596]
the higher authority
[597]
of law over one's personal politics that
[600]
applies to candidates
[602]
and citizens by the way now how do all
[605]
these facts and historical lessons apply
[606]
in these 19 days ahead of us
[608]
well this is important let me try to
[610]
walk us through it
[611]
first this is up to the referees not the
[614]
players
[615]
so we should all look to the state
[616]
officials and the courts
[618]
to make tough calls not the candidates
[621]
on the field
[622]
second we have to get it through our
[625]
heads
[626]
there is no such thing as election night
[628]
anymore this could take time and we all
[630]
need to be ready from voters
[632]
and the political class to yes the media
[635]
which has made mistakes by trying to get
[637]
ahead of the ballots not only
[639]
in the past not only infamously in 2016
[641]
but again
[642]
just in these last midterms where people
[644]
on tv
[645]
got things wrong by trying to make
[647]
predictions
[649]
too early when the ballots weren't all
[651]
in about an election
[652]
too soon
[655]
it is entirely possible that the
[657]
democrats will regain control
[659]
of the house today but i have to say
[661]
when you look at what's going on here
[662]
tonight this is not a blue wave
[665]
i see the chances of a wave kind of
[667]
dissipating every time i see something
[669]
on the board
[670]
pickups of 40 and beyond would amount to
[672]
much more significant
[674]
size majority at the moment democrats do
[676]
not believe that it'll be
[678]
that big of a majority
[682]
wrong each of those claims were wrong
[685]
some on our air some on other air all
[688]
wrong democrats
[690]
did go on to gain 40 seats in a historic
[694]
blue wave some call it a tsunami now the
[697]
point here is not that those
[698]
pundits were too overconfident
[702]
they were just too early trying to
[704]
analyze and report on races as if they
[706]
were finished when the counting was
[708]
still going
[709]
not just that night or that week but we
[711]
looked this up
[712]
all the way until december 6th that's
[714]
when the last
[715]
outstanding house race in california was
[717]
called and you can't measure the wave or
[719]
how many seats were won in the house
[721]
until
[722]
all the seats have been resolved now
[724]
this year the media and political class
[727]
we all have to work on this we have to
[729]
avoid chasing results too early
[731]
to paraphrase asap ferg chasing chasing

chasing

all this ballot chasing i'm like a bad

i ain't got no patience this year we all

have to have a little more patience than

a bad doctor

now if you take it all together this

could be one of the more important

things

in this year's election you know at this

week's supreme court nomination hearings
[758]
there was much talk about tradition and
[760]
originalism
[761]
but america's original tradition does

not provide
[765]
for one election day for many decades
[767]
states held different election days over
[769]
a longer period
[770]
and the constitution as we just walked
[772]
through provides weeks to tally and
[773]
certify votes
[775]
now many things are different in 2020
[778]
but not this and while people like fast
[781]
results we like instant information
[783]
there's actually a deeper point here a
[786]
healthy democracy honors
[787]
fair rules for all consistently
[790]
even as the world evolves around us the
[793]
ground rules are the same
[795]
even as society shifts you know i could
[797]
quote a founding father for that idea
[799]
but

let's reach for a more contemporary

elder the great morgan freeman

who just dropped some of this very

even as we are different we're changed

by the pandemic

for change by four years of trump will

things be better or worse

this time we don't know yet

the answer is up to the voters and we'll
