[13]
hello everyone and welcome to another
[15]
episode of coffee with carl i am your
[17]
host carl zellner one of the attorneys
[18]
here with anderson business advisors uh
[20]
and today i want to talk about
[22]
california specific topic
[24]
which is our friend here ab5
[28]
ab5 is a piece of legislature that was
[30]
passed that
[33]
how to say this
[35]
how to say this politically correct uh
[37]
it sort of attacks
[39]
gig workers for companies such as uber
[42]
lyft doordash
[44]
those type of companies
[46]
what it does is it reclassifies
[48]
independent contractors as employees
[52]
and creates some additional burden on
[54]
those companies that use those gig
[56]
workers for service
[58]
there has been several updates and
[60]
exemptions since ab5 has come out
[64]
most recently there were the most recent
[66]
update was on september 4th of 2020
[70]
which
[71]
now added a long list of exemptions
[74]
for different types of job categories so
[76]
you may fall depending on who you are
[78]
and what you're listening to here
[80]
you may fall into that long list of
[81]
exemptions
[83]
however
[84]
uber lyft and doordash drivers uh those
[89]
sort of gig economy folks have not yet
[92]
been exempted uh so this is more of an
[95]
update here there is right now in
[97]
california um
[100]
proposition 22 which would work to
[103]
exempt those type of drivers but it has
[105]
not yet passed and we don't know if it
[108]
will pass so it's one of those let's see
[113]
i believe the technical numbers ab2257
[116]
or proposition 22
[119]
so that would create even more classes
[121]
of exemptions so i know a lot of our
[123]
clients and a lot of clients in
[125]
california have run into ab5 issues so
[128]
that's why i want to address this today
[130]
because like i say it basically
[133]
changes independent contractor work into
[136]
employee or w-2 work
[138]
which creates some additional burdens on
[140]
employers so it's affected a lot of
[142]
folks in california so i want to give a
[144]
little bit of an update there is a new
[145]
list of exemptions a long list of job
[148]
category exemptions so if you've been
[150]
struggling with this
[152]
probably pays to look or you can call us
[155]
and we'll take a look for you
[157]
so ab5 we're keeping an eye on it
[159]
hopefully
[160]
all my gig workers my uber lyft doordash
[163]
folks
[164]
hopefully this will be something of the
[167]
past because otherwise i think there's
[168]
going to be continue to be the mass
[170]
exodus from california so
[173]
that's it for this episode of coffee
[175]
with carl i don't plan to go into the
[177]
three-prong test or any of those items
[179]
at this point
[181]
for the most part anybody who is
[183]
independent contractor or gig worker
[186]
knows they've been sort of hosed by ab5
[189]
so really the relevant pieces that are
[191]
left are to see which exemptions sort of
[193]
finally shake out of this thing so that
[195]
everybody can get back to normal so
[198]
until next time
[199]
