in this video i'll be answering the

question what is the date of first
[17]
delinquency
[18]
the date of first delinquency is the
[21]
date that somebody first
[23]
falls behind on payments and this date
[26]
is very important because it ensures
[29]
compliance
[30]
with the fair credit reporting act that
[32]
means that an
[33]
error in this date can give rise to
[36]
a lawsuit under the fair credit
[39]
reporting act it's a violation of the
[40]
law
[41]
now in order to bring a lawsuit you'll
[43]
have to first dispute the inaccurate
[45]
information
[46]
and i've got videos about that it's a
[48]
whole process in and of itself
[50]
but data first delinquency is important
[53]
because it ensures a number of things
[55]
how is the data first delinquency
[57]
calculated or figured out
[59]
well the date of first delinquency is
[61]
not the charge off date
[62]
it's not the date that the credit card
[64]
company says that they
[66]
are charging off the debt and selling it
[68]
to
[69]
a third party debt collection agency or
[72]
sending it to lawyers for collections
[74]
the data first delinquency is well
[76]
before that
[77]
um the date of first delinquency is the
[80]
date that a consumer
[81]
first falls behind their payments so for
[84]
example

if your minimum payment is 500 and you
[88]
pay
[89]
400 or 450 then
[92]
your first delinquent on that date let's
[95]
say that's january
[97]
now if you
[100]
continue to make payments to the credit
[101]
card company and they continue to accept
[104]
them
[105]
then they may not put your account out
[109]
for charge offers start the charge off
[111]
process
[112]
so if you pay close to
[116]
what's what the minimum payment is in
[117]
february and march they may
[120]
work with you and not put you into the
[123]
charge off process
[124]
now eventually
[128]
so you'll either fall behind completely
[129]
or you'll catch up
[132]
and if you fall behind completely the
[134]
charge off process will start and this
[136]
is what that looks like

that's six months of non-payment and the
[142]
account gets charged off
[143]
so that process is separate and if you
[146]
pull yourself
[148]
out of the charge-off process or you
[150]
catch up on your delinquencies
[152]
then you're current again and when
[155]
you're current
[156]
again if you fall behind again then the
[158]
data first delinquency goes back to
[161]
the post catch up for data first
[164]
delinquency
[166]
and the data first delinquency is when
[167]
you
[169]
are delinquent and doesn't have to be a
[171]
non-payment just even just a little bit
[173]
delinquency
[174]
that's the data first delinquency and
[177]
it's important

because creditors and debt collectors
[180]
especially will want to push this date
[182]
as far forward as possible
[184]
and it's to your benefit to push it as
[185]
far back as possible
[187]
so a debt collector will say that it's
[190]
the charge off date
[191]
and we'll say that it's the date you
[193]
first fell behind
[195]
even a little bit because the statute of
[197]
limitations will be put
[199]
pushed back by at least six months in
[201]
texas the debt collector has
[203]
four years to sue you to collect debt
[205]
and if that date is further back
[206]
then that's to your benefit
[210]
so another thing that's related
[213]
to the data first delinquency is when
[215]
you look at your credit report
[216]
you'll see the reporting for each
[219]
account it'll
[220]
normally say current or cccc and
[224]
then you'll see 30 60 90 120 days late
[228]
that's related to the data first
[230]
delinquency credit reporting is
[233]
all interrelated it's like a web you
[234]
push over here and something moves over
[236]
here
[236]
so um with the data first delinquency
[241]
it's related to the current status and
[244]
the number of
[245]
days late so it's interesting to look at
[248]
this because if you're current in
[250]
january you can't be 90 days late in
[252]
february
[253]
the furthest you could be late in
[254]
february would be 30 days
[257]
and then 60 days in march
[260]
and then 90 days in april and 120 days
[264]
in may
[265]
so it's important to look at your credit
[268]
report closely
[269]
because if you're suddenly 60 days late
[274]
or if you go from 30 to 90 days late or
[277]
if there's any kind of gap
[279]
between the the dates
[282]
if there's a time travel in your credit
[284]
report
[286]
then something's wrong that's inaccurate
[288]
it's impossible
[290]
for that to happen and that's the basis
[292]
for a dispute and if it's not cleared up
[294]
potentially a lawsuit
[297]
because the further late you're reported
[300]
the worse your credit score is
[301]
if you were 30 days late on something
[303]
and then you caught up
[305]
that's not as bad as being 60 90 or 120
[308]
days late
[310]
so it's important these dates are
[311]
accurate
[315]
