Today I'm going to be talking about the new 1099k聽聽

reporting rules from the IRS. And really the聽
only reason I'm doing this video is because聽聽
[11]
it's so frustrating to see the outrage, and the聽
misinformation, and all the bullshit going on聽聽
[18]
on social media. So, I figured it'd be worth聽
a video to hopefully get some actual relevance聽聽
[24]
and correct information out there so people stop聽
freaking out about it alright. But first before聽聽
[29]
I get into it I'd love it if you'd consider聽

all that jazz. Alright so on to the 1099K. What聽
is the 1099K? So basically prior to 2022 if you聽聽
[48]
have a business and you accepted payments via聽
credit card, Paypal, Venmo as business payments,聽聽
[57]
the reporting agency like let's say Paypal would聽
have to issue you a 1099K if you exceeded over聽聽
[65]
$20,000 of sales through Paypal. So that means聽
you know, you'll get a copy of the 1099K and then聽聽
[71]
they will also issue one to the IRS. So that's, so聽
that the IRS knows that you made at least $20,000聽聽
[77]
of income through Paypal. Same thing with the聽
credit card merchants. You know, if you made more聽聽
[82]
than $20,000 in sales then they would issue you a聽
1099K. So the new rules in the IRS for 2022 moving聽聽
[91]
forward is that they've lowered the $20,000 limit聽
down to $600, meaning if you made over $600 then聽聽
[99]
you're going to receive a 1099K. And you know, if聽
you're familiar with independent contractor rules聽聽
[105]
you know, where you, you know prior forms were聽
called the 1099 Miscellaneous, now contractors to聽聽
[111]
pay with the 1099 NEC. The reporting rules are the聽
same here where if you were paid more than $600聽聽
[118]
as a contractor then you should be issued a聽
1099NEC. So this is kind of mimicking that rule聽聽
[126]
of the contractors except with just credit card聽
and payment services. Now why are people freaking聽聽
[132]
out about this? Well the complaints I've heard聽
on social media are that this is total government聽聽
[138]
overreach. They're just trying to see what聽
you're doing. Trying to look into your privacy.聽聽
[143]
And you know, they're trying to figure out what's聽
going on with you, track your money, okay. Another聽聽
[149]
complaint is they're trying to steal, they're聽
trying to steal my money. They're trying to steal聽聽
[153]
the money that I'm making by you know, taxing聽
it. Or people are complaining well what if I聽聽
[161]
pay my boyfriends half of the rent for the month聽
and he gets taxed on it or I get taxed on it?聽聽

And that's first of all, that's not even how that聽
works. But you know, now they're going to tax us聽聽
[172]
because I'm paying my boyfriend through Venmo on聽
half of the rent. And the last complaint I see is聽聽
[177]
just people with businesses basically saying that聽
they're going to switch to cash only now because聽聽
[184]
this is bullshit. I'm going to switch to cash only聽
so that the government doesn't know what the hell聽聽
[189]
I'm doing and so they can't tax my money okay. So聽
the first complaint or the first issue with that聽聽
[195]
logic is that if you own a business and you're聽
switching to cash only so that you can avoid聽聽
[202]
taxes, that's illegal. That's called tax evasion.聽
That's under reporting income, tax fraud, whatever聽聽
[209]
the hell you want to call it, that's illegal聽
okay. So don't do that. All the complaints I聽聽
[214]
just mentioned are really misguided and it's just聽
because people who are not familiar with the tax聽聽
[221]
code are sharing these news stories and you know聽
creating outrage over them when they have no idea聽聽
[228]
what the fuck they're talking about. So I want聽
to talk about the difference between like income聽聽
[232]
activities and non-income activities and what's聽
going to be reported on the 1099K. So first are聽聽
[238]
income activities. If you have a business聽
and you sell stuff for money, for a profit,聽聽
[244]
that is an income activity okay, that's anything.聽
If you own a business and you take credit cards,聽聽
[250]
if you take Paypal or Venmo as payments, and聽
you're selling a good or service for profit, that聽聽
[257]
is income. And that should be reported on your tax聽
return regardless if you get issued a 1099 or not.聽聽
[264]
What if you are your reselling items on eBay or聽
Craigslist? Well if you are selling items for聽聽
[269]
profit, that is income and you should be reporting聽
it on your taxes. No I don't mean selling your聽聽
[275]
three-year-old tv for 100 bucks. That is not聽
for profit because you likely bought that tv聽聽
[280]
for more than 100 bucks. I'm saying if you are you聽
know, scouring Craigslist for really good deals聽聽
[287]
and then selling them for a higher price than聽
you found them for that is an income activity.聽聽
[292]
That is reselling. That should be considered聽
income and should be reported on your taxes聽聽
[298]
regardless if you got a 1099 or not. And you know,聽
basically now if that's the case, you might have聽聽
[304]
to report this income now if you haven't been聽
doing it before okay. And if you haven't been聽聽
[309]
doing it before then you have been not following聽
IRS guidelines. Okay so what kind of activities聽聽
[315]
are not income activities? You know this includes,聽
like I mentioned before, selling old items on聽聽
[321]
Craigslist or eBay or Facebook Marketplace uh聽
typically are not income activities because聽聽
[326]
you're just getting rid of stuff, kind of like聽
garage sales okay. You're likely selling these聽聽
[331]
items for a huge loss because they're used,聽
they're old, you do not get more money than聽聽
[337]
you paid for them. Another thing is that is not聽
an income activity is if you were you know, if聽聽
[342]
you went to a fun little lunch with your friend at聽
Benihana and your friend paid for it and then you聽聽
[349]
wanted to pay him half of it back on Venmo because聽
you know you felt like that was the right thing聽聽
[354]
to do. That is not an income activity to your聽
friends. That is not going to generate a taxable聽聽
[361]
1099 document. You know if you do this 20 times聽
over the year to the same friend, you paid him,聽聽
[366]
paid the same friend and maybe you exceeded over聽
a $1,000 in payments he's not going to get a 1099聽聽
[371]
for that because that's not an income activity.聽
You're just reimbursing your friend. And another聽聽
[377]
complaint I see is what if you're just paying your聽
spouse half of the rent or half of the mortgage聽聽
[383]
because you know they pay for the whole thing out聽
of their primary bank account and then you just聽聽
[388]
want to pay them back each month. That is also聽
not an income activity to you or your spouse.聽聽
[393]
So that won't be reported on 1099K. And I hope a聽
lot of people just calm their asses down on this聽聽
[399]
okay. So how does PayPal or Venmo know whether聽
or not you're paying someone for Benihana聽聽
[407]
or if you're paying someone for a good or service聽
for a business? Well how are they supposed to know聽聽
[412]
that? Are you supposed to notate on the notes聽
you know, hey this is for my fun little lunch聽聽
[417]
with my friends, and this is for like a massage聽
that I paid for for a profitable service, service聽聽
[423]
or business? Well when you go to pay somebody on聽
PayPal or Venmo right before you pay them you have聽聽
[430]
the option to choose whether you you're paying聽
a friend or you're paying for goods and services聽聽
[436]
okay. Goods and services usually through Venmo聽
or PayPal offer like a customer protection and a聽聽
[444]
refund policy and all the stuff that allows you聽
to get your money back if you were to receive聽聽
[450]
like a shitty product or a service. Then聽
you have a process to claim your money back聽聽
[456]
and get a refund. Paying for goods or services聽
as a business also will charge the seller a fee.聽聽
[462]
So that's you know, the main thing that you'll聽
see there is when you pay for goods and services聽聽
[467]
the seller will be charged with fees so that聽
PayPal can accommodate customers who have聽聽
[473]
refunds, claims, and all that聽
stuff. If you're paying a friend聽聽
[477]
with your checking account then there usually is聽
no fee through PayPal or Venmo. You also can't聽聽
[484]
have any process to get that money back聽
because if you're really just paying a friend聽聽
[488]
then you can just ask your friend hey dude just I聽
overpaid you please send me some money back. Okay聽聽
[495]
so if you pay for something, if you pay for聽
something as a goods or service that would聽聽
[499]
count towards the 1099K reporting for the person聽
that you're paying. If you're paying somebody as聽聽
[504]
a friend that will not count towards the 1099K聽
reporting for your friends. If you're selling聽聽
[511]
your old stuff on Craigslist and you're worried聽
about people choosing the option that they're聽聽
[516]
paying you as a good or service just please聽
ask them not to because this, because you know聽聽
[522]
I have not had that happen to me. I'm sure聽
it's happened to some people but you know how,聽聽
[527]
how pissed off would you be if you're selling your聽
old tv for 100 bucks and then your buyer pays you聽聽
[533]
and you receive like $85 of it because PayPal took聽
what, took out like $15 of fees. Then you're not聽聽
[539]
really getting 100 bucks and you know this is not聽
really like a, like a transaction that should be聽聽
[545]
a sale of goods or services even聽
though that's what it says on PayPal.聽聽
[550]
I wish they would make that wording a little聽
more clearer you know because that is not like聽聽
[554]
a taxable transaction. So I, you know, I hope that聽
PayPal or Venmo make those options a little more聽聽
[560]
clear for people so they actually just like like聽
paying a friend. When you're buying, when they're聽聽
[565]
buying your old stuff on PayPal or Venmo. Should聽
you be worried about the change of this rule? I聽聽

would say no. The only people that should truly be聽
worried are people that are under reporting income聽聽

or not reporting income at all that, when聽
they should be reporting it. You know the,聽聽
[583]
the folks that are screaming that they're going聽
to take their business to all cash now, those are聽聽
[589]
the people that should be worried okay. Because聽
they were probably not reporting their income聽聽
[593]
anyway. And another note there, if you are paying聽
somebody for a, as a business for goods or service聽聽
[601]
and they specifically ask you not to pay them聽
as a business, and they ask you to pay them聽聽
[606]
as a friend, I would probably not work with聽
that person. You know they are either trying聽聽
[611]
to avoid taxes or the goods or services they're聽
providing are really not adequate, so they don't聽聽
[616]
want any type of claim of refunds processed on聽
their goods or service. So it's one thing to聽聽
[622]
forget to pay them as a business or it's one聽
thing to just pay them as a friend and just聽聽
[626]
not even think about it. It's another to ask your聽
customers to not pay them as a business. That is,聽聽
[633]
that takes a whole new level of shadiness in my聽
