I've been appointed the personal representative聽 and a deceased probate estate in Michigan and now聽聽

it's time to present the inventory hi I'm聽Darren聽 Findling of The Probate Pro. We're gonna walk聽聽

step-by-step through form PC five seven seven聽 that is a state court administrator form for the聽聽

preparation of the required inventory this form聽 is required under both Michigan statute as well聽聽
[30]
as Michigan Court Rule we strongly urge you to聽 use an experienced competent probate lawyer when聽聽

completing this form and to refer to the statutes聽 and court rules that identify how to complete the聽聽

form we're going to explain how this form works聽 specifically how you complete it and then what聽聽
[51]
the rules are relating to service this form must聽 be presented to the probate court within 91 days聽聽

of the appointment of the personal representative聽 now notice I didn't say the word filed because in聽聽

Michigan the presentation of the inventory in an聽 unsupervised administration is the requirement聽聽
[70]
what does that mean it means that you bring the聽 inventory down to the probate court the probate聽聽

court looks at it and calculates the gross聽 inventory fee it does not require the filing聽聽

of the inventory unless the estate is supervised聽 or ordered by the probate court that it must be聽聽

filed it's an important consideration because聽 the idea in Michigan is that unless it's a聽聽
[96]
supervised administration the inventory and the聽 assets identified within the inventory are kept聽聽

private private among those that are interested聽 within the estate so after the farm is presented聽聽

to the probate court and the inventory fee is聽 identified or determined then it must be served聽聽

upon the interested persons as defined under the聽 Michigan Court rules now this particular form gets聽聽

completed and then served among the interested聽 parties and that gross inventory fee must be paid聽聽

either before the sworn story statement closes聽 filed the the order for complete administration聽聽

or petition for the filing for the closing or聽 within one year failure to do this or any of聽聽

these steps subjects the personal representative聽 to a deficiency which could cause removal or聽聽

sanction now at the top of this form in the red聽 box you'll you'll see that there's a little check聽聽

box for whether this is an amended inventory or聽 the original inventory that box would be only聽聽

checked if you're amending this and it had already聽 been presented below and that red box identifies聽聽

the court rules and statutes as well as the form聽 let's work our way through this document these are聽聽

pretty intuitive areas to fill out top left corner聽 identifies the county in which the probate court聽聽

is filed and then the file number is identified聽 in the top right corner moving further through聽聽

the document identifies the name of the deceased聽 estate as well as the personal representative that聽聽

is completing the inventory in addition the聽 date of death is identified because it is the聽聽
[199]
fair market value of the asset like a snapshot聽 taken as of the date of death that's relevant聽聽

now really the crux of this document is in this聽 larger section that we highlighted in red your聽聽

to identify assets of the decedent now let's聽 talk about what that means that means an asset聽聽

that has no joint owner an asset that has no named聽 beneficiary and an asset that is in the individual聽聽

name of the decedent so for example the asset was聽 in a trust that wouldn't go on this if an asset聽聽
[234]
was jointly held with another person it wouldn't聽 go in this form as well as a life insurance policy聽聽

with a name that officiate but any asset in the聽 individual name that doesn't meet those criteria聽聽
[245]
would be listed here you identify the nature of聽 the asset as well as its value and then if there's聽聽
[253]
any liens so for example with a house in real with聽 real estate you identify the value of that house聽聽

either by using the state eagle-eyes value or聽 an appraisal or and sale you get to subtract the聽聽

liens mortgages and encumbrances that have been聽 recorded or that are attached to that particular聽聽

asset to come out with that inventory value on the聽 far right in addition you get to identify or you聽聽

should identify any other assets of the decedent聽 these could include bank accounts financial聽聽

institutions and so on we generally don't go聽 down to the nitty-gritty like you know little聽聽

personal items within a property unless there's聽 a dispute among the family now of course it is聽聽
[298]
incumbent upon the personal representative to use聽 a valuation but there's no guidelines other than聽聽
[304]
real estate as to how the valuation should occur聽 you can use an appraisal especially if there's a聽聽
[310]
fight going on but otherwise it's dependent upon聽 the personal representative to use a reasonable聽聽
[316]
valuation so that the court can calculate that聽 inventory now this document really serves two聽聽
[323]
purposes one it is for the court to be able to聽 assess that inventory fee and second to give the聽聽
[331]
other interested parties an understanding of what聽 assets are flowing through the probate process to聽聽

understand the various aspects of this permit聽 process of course you can rely on other videos聽聽

that I've put together or follow the statutes to聽 understand the timeline of process now below the聽聽

line is also a pretty intuitive self-explanatory聽 section this is where you identified who's signing聽聽

the document as well as whether there's an聽 attorney of record above that is a really聽聽

critical sentence though it is a declaration that聽 that document is being signed under the penalties聽聽

of perjury so again I think everyone has a聽 general sense of what that means you got to聽聽

tell the truth or you subject yourselves to the聽 penalties that perjury provide now this process聽聽

of completing an inventory you're presenting聽 it and serving it for some it's quite easy聽聽
